1. INTRODUCTORY PROVISIONS
These General Terms and Conditions (hereinafter: "General Terms") govern the terms of use of the website https://grobovi.zale.si/ (hereinafter: "website") and the terms of purchase and use of the services offered by:

(hereinafter: "provider").
The General Terms are binding on the user, who must read them in their entirety. By using the website and making a purchase, the user confirms that they are familiar with these General Terms and agree to them completely.
2. DEFINITIONS
- Website: The website at the address https://grobovi.zale.si/.
- User: Any natural or legal person who visits or uses the website.
- Buyer: A user who makes a purchase of a service on the website.
- Service: The service of leasing space for the publication of a virtual candle or virtual flower at a selected memorial site on the website for a specific period of time.
- Virtual candle/flower: A digital (graphic) element that is displayed next to the name of the deceased on the website for a certain period.
3. SERVICE OFFER AND PRICES
The provider offers the service of publishing virtual candles and virtual flowers. The services are available for different time periods and at prices that are clearly stated on the website.
Price list:
- Virtual candle/flower (1 day): Free of charge (0.00 EUR). The service does not include the option to add a message.
- Virtual candle/flower (3 days): 0.99 EUR. The service includes the option to add a message.
- Virtual candle/flower (30 days): 2.99 EUR. The service includes the option to add a message.
All prices are in euros (EUR) and include value-added tax (VAT), as the provider is a VAT payer. The prices are valid at the time of order submission. The provider may change the prices at any time, whereby the prices at the time of order submission apply to already submitted orders.
4. PURCHASE PROCESS
- The user selects the desired memorial site on the website.
- The user selects the type of service (virtual candle or flower) and the desired duration of the publication (1, 3, or 30 days).
- For paid services, the user can optionally enter a message. The user is fully responsible for the content of the message. The message must not be offensive, illegal, discriminatory, or infringe on the rights of third parties. The provider reserves the right to remove inappropriate content.
- The user proceeds to the payment process by clicking the "Pay" button or a similarly labeled button.
- The user selects the payment method and enters the required information.
- The service contract between the buyer and the provider is concluded at the moment the provider sends a confirmation of successful payment to the buyer's email address.
- The provider does not assume responsibility for technical disruptions or non-operation of the website for reasons beyond its control.
5. PAYMENT TERMS
The provider allows the following payment methods: credit card payments (Visa, Mastercard), PayPal, Google Pay, and Apple Pay.
The provider ensures secure payment conditions through an external payment service provider.
The provider does not store payment card data; payments are processed by an external certified provider.
After a successful payment, the buyer will receive a confirmation to their e-mail address (if this information is required).
The provider is not responsible for any errors that arise from incorrectly entered data by the buyer, especially an incorrect email address, which may result in the payment confirmation not being delivered.
6. SERVICE EXECUTION AND USER RESPONSIBILITY
The service of publishing the virtual candle/flower and message begins immediately after the confirmation of successful payment has been sent.
The buyer is fully responsible for the content of the message they publish. The provider is not responsible for opinions, comments, or other content published by users. The provider reserves the right to remove any message without prior notice and without a refund if the message:
- is offensive, hateful, threatening, or obscene,
- contains personal data of third parties without their consent,
- constitutes commercial advertising,
- is contrary to the applicable legislation of the Republic of Slovenia.
The provider reserves the right to temporarily disable the publication of content for technical or security reasons.
The provider does not guarantee the constant availability of the digital content.
7. RIGHT OF WITHDRAWAL
In accordance with the Consumer Protection Act (ZVPot-1), in the case of distance contracts, the consumer generally has the right to notify the company of their withdrawal from the contract within 14 days, without having to state a reason for their decision.
However, an exception applies to the services offered by the grobovi.zale.si website.
In accordance with point 1 of the thirteenth paragraph of Article 43.č of the ZVPot-1, the consumer does not have the right to withdraw from a contract for the supply of digital content which is not supplied on a tangible medium if the performance has begun with the consumer's express prior consent and with the acknowledgment that they thereby lose their right of withdrawal.
By clicking the "Pay" button and completing the purchase process, the buyer EXPRESSLY AGREES that the performance of the digital service (publication of the virtual candle/flower) shall begin immediately. The buyer is informed before the completion of the purchase and EXPRESSLY CONSENTS that with the immediate start of the service performance, they LOSE THEIR RIGHT TO WITHDRAW FROM THE CONTRACT and thus the right to a refund.
8. COMPLAINTS
In the event that the service was not performed in accordance with the order (e.g., a technical error in the display, incorrect duration of the publication), the buyer can file a complaint to the e-mail address iskalnik.trgovina@zale.si. The provider undertakes to resolve the complaint within 10 days.
9. PERSONAL DATA PROTECTION
The provider is committed to protecting personal data in accordance with applicable legislation (GDPR and the Personal Data Protection Act). More information about the collection, processing, and protection of personal data is available in our Privacy Policy, which is published on the website.
10. FINAL PROVISIONS
For all matters not regulated by these General Terms, the applicable legislation of the Republic of Slovenia shall apply.
Any disputes between the provider and the buyer will be resolved amicably. If an agreement is not possible, the competent court in Ljubljana has jurisdiction to resolve disputes.
The provider reserves the right to change the General Terms. Any changes will be published on the website. The amended terms and conditions shall enter into force on the day of publication.
